Since the enactment of the most important Mexican product liability law in 1992, the Mexican Consumer Protection Federal Law (Ley Federal de Protección al Consumidor), we have assisted clients with all regulatory concerns arising from the guidelines derived from the law to ensure compliance of products, known as Mexican Official Standards .
Our work involves guiding clients throughout all the product liability process to achieve compliance in the import, commercialization or use of their products, regardless of the industry they do business in. This includes obtaining necessary permits or governmental authorizations, as required, and carrying out the alternatives of a product recall if a manufacturer or supplier finds a hidden defect regarding the quality, mark, specifications or other substantial elements of its product.
Likewise, our team in Mexico City has represented clients in litigation procedures, bringing actions before relevant authorities to claim the improper use, publication or commercialization of products entailing potential violations to Mexican law, including sanitary provisions and intellectual property protection.
We represent clients in regulatory and litigation matters, advising product manufacturers, distributors and retailers on regulatory compliance to obtain necessary permits and authorizations from relevant authorities, as well as identifying preventive measures to avoid claims.
